This legislation establishes regulations for electric assisted bicycle, "e-bikes" and defines three classes of e-bikes. E-bikes would follow the same rules of the road as human powered bikes and local governments would have the authority to allow or restrict the use of e-bikes on bicycle paths or shared paths where bicycles are permitted.

This legislation renews the fees that make up the Hazardous Waste Trust Fund (HWTF) and the Solid Waste Trust Fund (SWTF) for three years, from July 1, 2019 to July 1, 2022. 

Effective from July 1, 2020, until June 30, 2022, the  75¢ per ton of solid waste disposal fee would be reduced to 51¢ per ton. Effective from July 1, 2020, until June 30, 2022, the $1 fee imposed upon the retail sale of all new replacement tires would be reduced to 38¢ per tire sold. In effect, the fees are reduced by the percentages that were not appropriated for their intended purposes in the last completed fiscal year, 2018.

The HWTF and SWTF support efforts including clean-up of abandoned contaminated sites, leaking landfills, scrap tires and illegal dumps; in addition, funds go towards waste reduction and recycling programs. 

ACCG supports the reauthorization of both trust funds but is advocating for the successful passage of HR 164, a constitutional amendment that authorizes the Georgia General Assembly to establish, by statute, true and dedicated trust funds.

This legislation changes the permitting requirements and definitions related to the Shore Protection Act. 

This bill also makes changes to the Shore Protection Committee: "Any permit for minor activity may be issued by the DNR Commissioner based on the recommendations of staff, past committee actions, and the results of public comments. The commissioner may refer the application to the committee to decide on permits for minor activities that, in his or her judgment, should receive broader consideration. A committee member may choose to have the full committee decide on permit applications for minor activities that the member feels should receive broader consideration."

HB 458 prohibits the use of per- and polyfluoroalkyl substances (PFAS) in Class B firefighting foam during training, unless it is used at a training facility capable of preventing the release of the foam into the environment. The bill does not restrict the use of foam containing PFAS for fire-fighting operations.

This legislation states that no permit shall be issued for a solid waste handling facility if any part of the site is within two miles of an adjoining county (current law is one-half mile) without the applicant's first receiving the consent of the governing authority of such adjoining county. The EPD Director can overrule this requirement if the applicant provides evidence that no alternative sites or methods are available in that jurisdiction for the handling of its solid waste. 

The legislation also requires that at least two weeks prior to giving such consent, the governing authority of the adjoining county must publish a notice in the county legal organ on the matter. In addition, the public notice requirements are expanded to require the EPD Director (once the department has received an application for a hazardous waste facility permit) to publish a notice in any adjacent county within two miles of the proposed location.

This legislation would require coal combustion residual (coal ash) to be stored in a solid waste facility that had a liner and leachate collection system that meets design standards required for new municipal solid waste landfills. In effect, coal ash residuals would be treated the same as municipal solid waste. This legislation is mainly in response to Georgia Power's plans to close their coal ash ponds - details found here. Similar legislation, SB 297, has been introcued in the Senate.

This legislation codifies state and federal rules regulating coal combustion residual surface impoundments (coal ash ponds). Post-closure care will take place for a minimum of 30 years that will include ground-water monitoring. In addition, EPD would be required to conduct an inspection of the coal ash pond at least annually during the closure period and at least once every five years following the completion of the closure.

This legislation establishes conditions for permits for facilities that emit ethylene oxide that includes providing proof to EPD that equipment has been installed that can detect and monitor ethylene oxide emissions from each exhaust point at the facility. In addition, the facility would be required to continuously monitor direct emissions of ethylene oxide and retain records of the daily release of ethylene oxide from each exhaust point. Such reports would be required to be submitted to EPD twice a year. Lastly, each facility would be required to create an ambient air monitoring plan that would include a quarterly air sampling with the results submitted to the local government where facility is located.
